This law removes the restrictive requirement for a cooperation agreement with a doctor after three years of APRN practice, expands the APRN prescription form and allows APRNs to sign documents that were previously only signed by doctors. It also removes the old statutes that restrict the individual practices of nurse midwives and certified nurses, to place them under the name Advanced Practice Registered Nurse (APRN). A practice contract is required between a medical practitioner and a PA. The agreement must be approved by the relevant authorisation committee and must include, inter alia, monitoring mechanisms and attitudes in which the PA will act. W. Va. Code §30-3E-10 As of August 2018, 45 PRs in West Virginia have obtained federal approval to treat opioid addiction with products containing buprenorphine. In accordance with its prescribed authority and appropriate training or experience, an NP may receive a federal exemption in independent practice to distribute products containing buprenorphine. An NP who prescribes in collaboration with a physician may be able to obtain a federal waiver with appropriate training or experience as long as the cooperating physician is certified, trained, or authorized to treat and treat patients with opioid use disorder. W. Va. Code §30-7-15b An APRN will submit a separate request for prescription.

There is a $125 fee. The APRN must verify a cooperation agreement. The largest beneficiaries of this legislation are the 170,000 new Medicaid recipients who acquired health care for the first time through Medicaid expansion and have so far not had access to adequate resources for primary care. Before this law was passed, the WV closed APRN practices because doctors could not sign cooperation agreements. Now, nurses can reopen practices in this state, where 50 of the 55 counties are considered undeserved health care zones. Nurse midwives are required to have formal, written cooperation agreements with obstetricians or other qualified physicians and submit them to the Board. APRNs requesting permission to write recipes must also submit cooperation agreements. West Virginia`s advanced practice nurses and other nurses are under the jurisdiction of the West Virginia Board of Examiners for Registered Professional Nurses. .
